Anthony DellaPelle interviewed regarding use of eminent domain for affordable housing project

MOUNT OLIVE TWP. – Mayor Robert Greenbaum said the township has no other choice but to use its power of eminent domain to buy a deteriorating, former nursing home in Budd Lake and convert it into housing for low- and moderate-income families. The Cobblestone Health Care Facility on Stonewald Court has been empty since it was closed in 2008 as a result of an agreement with the state. She knew the market was bad, but she had to go because about a year ago she took a new job in Virginia. The house had selling points. McKirdy & Riskin’s Anthony DellaPelle was recently interviewed and quoted by the Star-Ledger’s MaryAnn Spoto in her article regarding an appellate court’s decision to uphold a $375,000 jury award for a Harvey Cedars couple who claimed that a beach replenishment project reduced the value of their oceanfront home, because it ruined their ocean view.  The case was the latest of beach replenishment cases along the Jersey shore, where municipalities have been using federal funds to rebuild beaches and sand dunes by pumping sand onto the shore to push back against the tide.  The recent Star-Ledger story is available here.

On February 8, 2012, McKirdy & Riskin’s Thomas Olson and Richard DeAngelis served as panelists at the Morris County Bar Association’s Real Estate Tax Appeal seminar, held at the Morris County Courthouse. Tom provided an overview of the tax appeal process to the attorneys in the audience, while Rich discussed recent case law developments in the property tax field.  Tom and Rich were joined on the panel by appraiser Matthew Krauser, CRE, FRICS, who spoke about valuation issues in property tax appeal matters.

Three attorneys from McKirdy & Riskin will be serving on the faculty of the New Jersey Redevelopment Authority’s “Redevelopment Training Institute” on October 4 and 5, 2011.  The course will be held at Thomas Edison State College in Trenton.  Anthony Della Pelle, CRE, has been selected as the lead instructor, is coordinating the course, and will be presenting lectures on “Redevelopment Gone Right or Wrong” on October 4, and “Property Acquisition, Eminent Domain and Relocation” on October 5.  John H.
